【活得閃亮ShineBrightLife】增強現實(特效濾鏡拍攝活動(「此活動」)由Rich Asia Management Limited安排創懿媒體有限公司(「創懿媒體」)作為主辦單位舉辦。
此活動的參加日期由2021年4月24日至2021年8月5日(包括首尾兩天) (「活動期」)。
通過參加此活動,您(下稱「您」或「參賽者」)不可撤銷地聲明及確認在參加此活動前已完全閱讀、理解並同意:

此活動於活動期內分為三個階段:
第一階段
對於此活動之登記資料及任何計時方面,將以創懿媒體伺服器所收集之數據作準。
投票方式:公眾人士需登入其個人Facebook帳戶,通過「讚好」參賽作品進行投票,並可以「讚好」多於一個參賽作品。在此活動的每個階段,獲得「讚好」次數最多的參賽作品,將成為優勝者(「比賽優勝者」),比賽優勝者都可以贏得PS5TM遊戲主機一部(「獎品」)。如果兩個或更多參賽作品獲得相同「讚好」的數量,則較早上載參賽作品完成登記的參賽者將被視為獲得更多「讚好」的數量。於整個活動期,每位比賽優勝者(按個人Facebook帳戶計算)只能最多贏得一份獎品。
創懿媒體將在此活動的每個階段結束時,於「智慧生利」的Facebook專頁上公佈比賽優勝者的名單。此活動不設上訴機制,您同意及承諾不會對創懿媒體宣布的比賽優勝者結果提出反對或作出異議。
如果比賽優勝者未能在指定地點及日期之前親自領取獎品,則該獎品將被作廢,而毋需另行通知和不獲賠償。
所有獎品不得轉讓或退還,亦不能兌換現金或其他產品。倘若獎品因任何原因而無法提供,創懿媒體保留提供價值相等的替代品的權利,比賽優勝者對此不得異議。
您必須保證、聲明及承諾您的參賽作品不會侵犯任何第三方權利或違反任何法律。您必須確保參賽作品為您個人原創作品。如有必要,您必須確保您的參賽作品均已獲得足夠的准許(例如相片以人為拍攝對象,需獲拍攝對象的准許)。若參賽作品含有任何不當內容,包括但不限於色情、淫穢、猥褻、暴力、褻瀆、誹謗、辱罵、脅迫、騷擾、政治或宗教聲明、非法資料、帶有種族、有關宗教及/或性別歧視的的負面評論、侵犯任何第三方權利或違反任何法律之內容、令人反感或不安的事物、影響利.晴灣23的形象或銷售、影響市區重建局或Rich Asia Management Limited的商譽、名聲或形象,創懿媒體對於不當內容的決定為最終決定,對所有參賽者具約束力,參賽者不得提出反對或作出異議。創懿媒體有絕對決定權删除該參賽作品而毋須給予任何理由及採取適當的法律行動。您需為您上載的不當內容負上可能涉及之所有民事及/或刑事責任。
凡提交您的參賽作品,即表示您向創懿媒體及其獲授權人士授予全球性、免版稅、永久、非專用及不可撤銷的許可,創懿媒體可於任何媒介(不論是目前已知或在隨後任何時間在世界上任何地方創造的媒介)使用、複製、編輯、展示、傳送、修改、刊發您的參賽作品,創懿媒體及其獲授權人士毋須為上述任何的處理方式向您支付或承擔任何性質的費用或賠償。您亦同意及承諾創懿媒體及其獲授權人士就其採取的任何處理方式均毋需通知您。
創懿媒體有絕對權取消任何人士參加此活動或得獎的資格,並對於任何對此活動作不利影響之行為採取其認為合適的法律行動。
此活動之參賽者,皆於決定參賽時,同意對於任何因參加此活動,及因接受、使用、誤用、或持有此活動所得獎品,而衍生之任何權利主張、損失與傷害,均同意免除、放棄、豁免市區重建局、創懿媒體、Rich Asia Management Limited與其控權公司、合作夥伴、附屬單位、廣告代理商、代理人、及其員工、經理人、董事和代表人所負之責任,並使之不因任何權利主張、損失與傷害而受有任何損害。創懿媒體毋需為以下情形承擔責任:任何人為操作或檔案傳送時造成的錯誤、疏漏、干擾、資料刪除或遺失、瑕疵或延遲;線路故障;參賽作品或報名資料遭盜竊、遭毀損或遭到未經授權的存取;或者報名資料遭竄改。創懿媒體也不對任何電話網路或線路、電腦網路系統、伺服器與提供商、電腦設備及軟體的問題或技術故障情形負責,且不因任何因網路或網站技術或連線、人為操作失誤,或以上多個因素綜合而導致之電子郵件訊息延遲收發狀況負責,包括因參與此活動所遭受、上載或下載此活動相關檔案所衍生、或與之有關而對參賽者本人與相關人士之電腦配備所造成之損失或傷害。
如發現您/對您參賽作品「讚好」的投票者以空賬戶、假賬戶或以任何方式入侵及/或以修改電腦程式的方式或創懿媒體有合理理由相信您/對您參賽作品「讚好」的投票者以任何不公平、不誠實、不正當或非法手段參加或促使他人參加此活動(包括「讚好」參賽作品)或在未取得創懿媒體事先同意下以任何利益促使他人參加此活動(包括「讚好」參賽作品),創懿媒體有絕對權取消相關您/對您參賽作品「讚好」的投票者的參賽資格/參加。
創懿媒體及其聯繫之員工及其廣告代理、Rich Asia Management Limited之員工及市區重建局之員工不可參加此活動。
若此活動因任何理由而無法依照計畫進行,如電腦病毒之感染擴散、程式漏洞、電腦蠕蟲、木馬程式、阻斷服務攻擊、非正當影響行為、非經許可之干涉、詐欺、技術事故,或其他任何創懿媒體無法控制之緣由,對此活動之管理、安全性、公正性、廉潔性、或正常運作產生侵害或影響時,創懿媒體有絕對權獨立判斷,淘汰試圖以非正當手段影響賽程或賽果之參賽者,或取消、終止、修改或中止此活動。若創懿媒體經決議取消或終止此活動,除檔案管理及內部作業所需的範圍外,創懿媒體將不再持有參賽作品之任何權利。
創懿媒體保留更改此條款及條件或取消、終止、修改或中止此活動之權利,毋須另行通知,亦不需要為此承擔任何責任。就任何有關此活動之爭論,創懿媒體擁有最終及具約束力之決定權。
本條款及條件的中英文版本如有任何差異,一概以英文版本為準。

The “ShineBrightLife AR Filter Shooting Campaign” (“Event”) is organized by M.One Media Limited (“M.One Media”) which is nominated as an organizer by Rich Asia Management Limited.
The Event runs from 24 April 2021 to 5 August 2021, both days inclusive (“Event Period”).
By participating the Event, you, as an entrant (“You” or “Entrant”), hereby irrevocably declare and confirm that before participating the Event, you have read, understood and agreed to:

Three phases of the Event will run during the Event Period:
Phase 1
M.One Media’s server will prevail in respect of any timing aspect of the Event.
Voting Method: Members of the pubic use their personal Facebook accounts to vote by giving a “Like” to the Entry, and they can “Like” more than one Entry. In each phases of the Event, the most liked entry will be the winner (“Winner”) and each Winner can win a PS5™ console (“Prize”). If two or more Entries obtain the same number of “Likes”, the entrant who submitted the Entry earlier will be deemed to have attained a higher ranking. Prize will be awarded in order of such ranking. Each Winner (counted by Personal Facebook Account) can only win one Prize during the whole Event Period.
M.One Media will announce the Winners at the end of each phase of the Event on the Facebook Page of Smart L Living. There is no appeal mechanism, you agree and undertake that you will not object to or disagree on the results of Winners announced by M.One Media.
If the Winner fails to collect his/her Prize personally by the date specified at the designated venue, the Prize will be forfeited without further notice and compensation.
The Prizes are not transferable or returnable, nor redeemable for cash or exchangeable for other product. Should the Prizes become unavailable for any reason, M.One Media reserves the right to provide a substitute prize of equivalent value and the Winners shall raise no objection thereto.
You warrant, represent and undertake that your Entry does not infringe any third-party rights or violate any laws. You must ensure that each Entry submitted is your own original work. You must ensure that your Entry has been sufficiently endorsed, if necessary, such as by obtaining permission from someone who might appear in a photo. If an Entry contains inappropriate content, including but not limited to pornography, obscenity, indecency, violence, profanity, defamation, abuse, coercion, harassment, political or religious statements, illegal information, racism, negative comments about any religion and/or gender discrimination, content that infringes or violates any third party’s rights or violate any laws, offensive or disturbing items, content that damages the image or/and the sales performance of L.Living 23 or content that damages the goodwill or/and reputation of Urban Renewal Authority (“URA”) and/or Rich Asia Management Limited, the decision regarding inappropriate content of M.One Media shall be final and binding on all Entrants and the Entrants shall raise no objection or disagreement. M.One Media reserves the absolute right to delete such Entry without giving any reasons and to take appropriate legal action. You shall be held responsible for any civil and/or criminal liability that may be involved in inappropriate content being uploaded.
By submitting your Entry, you grant M.One Media and its authorized persons a world-wide, royalty-free, permanent, non-exclusive and irrevocable license to use, copy, edit, display, transmit, modify, publish your Entry by using any medium (whether currently known or subsequently created anywhere in the world at any time) and will not require M.One Media and its authorized persons to pay or bear any costs or compensation of any nature. You also agree and undertake that you do not need to be notified of any such disposition carried out by M.One Media and its associated person.
M.One Media reserves the absolute right to cancel any person’s entitlement to participate in the Event or win any Prize, and to take appropriate legal action against any behaviour that adversely affects the Event.
By entering into the Event, all entrants agree to release, discharge, exempt and hold harmless URA, M.One Media, Rich Asia Management Limited and its partners, affiliates, subsidiaries, advertising agencies, agents and their employees, officers, directors, and representatives from any claims, losses, and damages arising out of their participation in the Event or any Event-related activities and the acceptance and use, misuse, or possession of any prize awarded hereunder. M.One Media assumes no responsibility for any error, omission, interruption, deletion or missing of data, defect, or delay in operation or transmission; communications line failure; theft or destruction of or unauthorized access to the Entries or Entry forms; or alteration of Entries or Entry forms. M.One Media is not responsible for any problems with or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email entry to be received on account of technical problems or traffic congestion on the Internet or at any website, human errors of any kind, or any combination thereof, including any injury or damage to entrants’; or any other persons’; computers related to or resulting from participation, uploading or downloading of any materials related to in the Event.
If it is found that you or a voter have/has used an empty account, fake account or has infiltrated and/or modified a computer program in any way, or M.One Media has reasonable grounds to believe you or a voter have/has been unfair, dishonest, improper or has adopted illegal means to participate in, or urge others to participate in, the Event (including awarding “Likes” to Entries) or procuring others to participate in the Event (including awarding “Likes” to Entries) without M.One Media’s consent, M.One Media has the right to cancel your participation and/or the eligibility of Winners or voters.
Employees of M.One Media and its advertising agencies, employees of Rich Asia Management Limited and employees of URA are not allowed to participate in the Event.
If for any reason the Event is not capable of running as planned, due to, for example, infection by computer virus, bugs, worms, trojan horses, denial of service attacks, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of M.One Media that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Event, M.One Media reserves the right, at its sole discretion, to disqualify any individual(s) who tamper with the entry process, and/or to cancel, terminate, modify, or suspend the Event. If M.One Media elects to cancel or terminate the Event, M.One Media will not retain any rights in the submitted Entries beyond the extent required for file management or internal administration.
M.One Media reserves the right to change these Terms and Conditions or cancel/terminate/change/suspend the content of the Event and/or the Event without further notice and without holding any responsibility for liabilities. In the event of dispute relating to the Event, M.One Media reserves the right of final and binding determination.
In the event of inconsistency between the English and Chinese versions of these Terms the Conditions, the English version shall prevail.
Notwithstanding anything to the contrary in the above terms and conditions, you / the Entrants shall irrevocably acknowledge, declare and confirm that you/he/she have/has completely read, understood and agreed the following before participating the Event:
